Terms and Conditions of Service
These Terms and Conditions of Service apply to all gardening, landscaping, pond installation, pond maintenance, and related services provided by Ripple & Root.
1. Acceptance of Quotation
Acceptance of a quotation, whether verbally, electronically, or in writing, shall constitute acceptance of these Terms and Conditions of Service.
2. Deposits
A deposit may be required before work commences to cover materials and secure the booking of works.
3. Quotations & Additional Work
Quotations are based on site conditions visible at the time of inspection. Any additional work required due to unforeseen circumstances or client-requested changes will be discussed and agreed before proceeding.
4. Site Access & Utilities
The client must provide safe and reasonable access to the site, together with access to water and electricity where required.
5. Timescales & Delays
Estimated start and completion dates are provided in good faith but may be affected by weather conditions, supplier delays, site conditions, or other circumstances beyond our reasonable control.
6. Adverse Weather
Certain works, including planting, turfing, excavation, pond construction, treatments, and ground preparation, may need to be postponed where weather conditions could affect safety, workmanship, or the long-term success of the project.
7. Materials & Product Availability
Where specified materials, plants, equipment, or products become unavailable, we reserve the right to substitute suitable alternatives of comparable quality following consultation with the client.
8. Completion of Works
Works shall be deemed complete when the agreed scope of work has been finished to a reasonable standard. Minor outstanding items that do not materially affect the completed works shall not delay payment becoming due.
9. Payment Terms
Payment is due within 7 days of the invoice date by bank transfer unless otherwise agreed in writing.
10. Ownership of Materials
All materials supplied remain the property of Ripple & Root until full payment has been received.
11. Liability
All work is carried out with reasonable skill and care. Liability is limited to the value of the work undertaken and excludes loss or damage arising from pre-existing defects, hidden services, underground obstructions, drainage issues, or other conditions not reasonably visible during quotation.
12. Hidden Conditions & Exclusions
Additional charges may apply for hidden ground conditions, buried pipes, cables, roots, contaminated materials, drainage defects, or any unforeseen issues discovered during the works.
13. Existing Services
The client is responsible for identifying the location of any known underground services, including water, gas, electricity, drainage, telecommunications, and irrigation systems. We accept no liability for damage to services that were not disclosed or reasonably visible.
14. Waste Removal
Removal of waste, soil, rubble, vegetation, or excavated materials is included only where stated in the quotation. Additional disposal requirements may incur extra charges. Logs, timber, soil, or wood chippings may be left on site at the client's request.
15. Plants, Turf & Living Materials
Plants, turf, and other living materials are subject to weather, pests, disease, and site conditions. We cannot guarantee their survival once installed and handed over to the client.
16. Pond Installations & Equipment
Following completion, the client is responsible for the ongoing operation, maintenance, and safe use of ponds, pumps, filters, lighting, and associated equipment unless covered by a separate maintenance agreement.
17. Maintenance Requirements
The long-term appearance and performance of gardens, planting schemes, lawns, ponds, and water features depend upon ongoing care and maintenance. Unless covered by a separate maintenance agreement, responsibility for ongoing upkeep passes to the client upon completion of the works.
18. Variations
Any changes to the agreed scope of works may result in additional charges and revised completion timescales.
19. Health & Safety
We comply with all relevant UK health and safety legislation and industry best practices. Clients must ensure that children, pets, and members of the public are kept clear of work areas while works are being carried out.
20. Insurance
For your peace of mind, we maintain Public Liability Insurance and Professional Indemnity Insurance appropriate to the services we provide. Copies of our insurance certificates are available upon request.
21. Photographs
We may take photographs of works before, during, and after completion for record-keeping, portfolio, marketing, and promotional purposes. Photographs will focus on the works undertaken and will not intentionally include individuals, vehicle registration numbers, house numbers, or other identifying personal information without consent.
22. Complaints
Any concerns regarding completed works should be raised within 14 days of completion to allow us the opportunity to inspect and resolve the issue.
23. Force Majeure
We shall not be liable for delays or failure to perform works due to events beyond our reasonable control, including severe weather, flooding, supplier shortages, strikes, accidents, illness, or government restrictions.
24. Cancellation Rights
Under the Consumer Contracts Regulations, you have the right to cancel this agreement within 14 days of accepting the quotation. To cancel, please notify us by phone or email. Any payments made will be refunded within 14 days of cancellation.
25. Work Started During the Cancellation Period
If you request work to begin within the 14-day cancellation period, you agree to pay for any work completed and materials used up to the date of cancellation.
26. Governing Law
These Terms and Conditions of Service shall be governed by and interpreted in accordance with the laws of England and Wales.
